Bayonne, New Jersey has implemented new regulations for short-term rentals (STRs), including specific rules for non-owner-occupied properties:

  1. Non-owner-occupied STRs are limited to 60 total nights per calendar year17.
  2. STRs are prohibited in dwelling units located in multiple dwellings that contain more than four separate dwelling units1.
  3. Only property owners can offer dwelling units for short-term rental use. Tenants are not allowed to operate STRs, with some exceptions1.

Exceptions and Grandfathering

For non-owner-occupied properties:

  1. If an owner was operating two properties as STRs before the ordinance adoption, they may continue to operate one non-owner-occupied property as an STR, provided it meets certain conditions1.
  2. Pre-existing contracts for STR use before July 1, 2024, are exempt from the new requirements1.

Permit and Registration

To operate a non-owner-occupied STR:

  1. Owners must obtain a short-term rental permit from the City of Bayonne Department of Planning, Zoning, and Development1.
  2. The initial registration fee is $1,000, with an annual renewal fee of $7501.
  3. Permits are valid for one year and are non-transferable upon property sale1.
  4. Owners must provide proof that the non-owner-occupied property was in use as an STR at the time of the ordinance adoption1.
